Drug offender to serve prison sentence in community
May 13, 2012 the RCMP investigated complaints of a loud party at Whistlers Campground.
When they arrived at the campsite, they saw Robert Kelly stumble, dropping a brown spray can. He quickly told the police not to worry, because it was just hash.
The officers searched Kelly and found eight grams of the drug Ketamine, as well as a cell phone, $140 cash and other drug trafficking paraphernalia in his backpack.
In court Oct. 24, Judge V. Myers sentenced Kelly to two years imprisonment, which he allowed him to serve in the community.
The 27-year-old will be subject to a curfew and strict monitoring, but will be allowed to leave his house for appointments, as well as his volunteer work.
The judge also forbade Kelly from possessing any restricted weapons for the rest of his life, and ordered him to give a sample of his DNA to police.
Im just happy to go back to my life, Kelly told the judge after the sentence.
Probation for man who spat at and slapped ex-girlfriend
Judge V. Myers sentenced an absent Richard Todd Hinecker to 12 months probation for assaulting his former partner.
In the afternoon of Sept. 1, Hinecker met his ex-girlfriend in Jasper to exchange custody of their kids. During the meeting, Hinecker got angry and spat at his ex and then slapped her in the face.
Hineckers lawyer told the judge the man had no criminal record, has struggled with addiction and anger issues, and had been going to Alcoholics Anonymous since the incident.
Along with his probation, Hinekcer was also ordered to pay a $50 victim fine surcharge.
Probation breach leads to fine
On July 19, the RCMP pulled over a car for speeding. When the officer approached the car he saw open liquor in the back seat, and noticed the smell of alcohol on Benjamin Micheners breath.
Michener was on probation at the time, stemming from breaking and entering and drinking and driving offences earlier this year.
In court Oct. 24, Myers gave Michener a $575 fine and told him if he breached his probation again he would land himself significant jail time.
