  1. Can an employer insist on a 30-day notice if I have worked for more than 90 days?
  2. No. Employees who wish to terminate their employment must give written notice. The length of notice is based on how long they have worked for the employer. If it is less than 90 days, than no notice is required. If it more than 90 days and less than two years, one week's notice is required. Anything over two years requires two weeks notice. Legally, an employer cannot insist on one month's notice as it contravenes the Alberta Employment Code.
  3. When can I expect to get paid if I have given proper notice?
  4. When proper notice has been given, the employee's earnings must be paid within three days of their last day of employment.
  5. Are their penalties for employers who do not comply to the Employment Standards Code?
  6.  All employers must meet the minimum standards in the workplace set out by the Employment Standards Code:
  7. Failure to meet the minimum standards may result in enforcement actions through an investigation process by Employment Standards.

  • Failure to comply with Employment Standards or enforcement action may lead to an administrative penalty and possible prosecution.
  • Multiple offences can lead to progressive penalties applied. Penalties range from $500 up to    
  • $6,000. Penalty amounts will increase with repeat contraventions if the contraventions occur within three years of each other.
